Legal Brief, 2: Instagram Dodges Copyright Claims on Embedded Photos

A three-judge panel at the 9th U.S. Circuit Court of Appeals has ruled against photographers who brought a class-action lawsuit in 2021 alleging that Instagram abused their copyright by allowing news outlets to embed the photos they themselves posted to their accounts. California Judge Charles Breyer agreed with Instagram’s request to dismiss the suit in February of 2022, saying that the news outlets weren’t actually displaying any “copies” of the photos, notes Gizmodo. The case is likely to continue, however: The appellate panel said that the photographers had raised “serious and well argued” policy concerns about copyright holders’ ability to control and profit from their work.   Read the full Story >>
