The U.S. Court of Appeals for the Ninth Circuit has revived a copyright infringement lawsuit by photographer Elliott McGucken, reversing an earlier decision by a lower court. McGucken brought a case against digital publishing company Pub Ocean Ltd after it used photos of a lake that had formed in Death Valley without permission. The lower court had ruled in favor Pub Ocean, which claimed fair use. The appeals court found that all of the fair use factors weighed against a determination that Pub Ocean’s unlicensed use of the photographs were transformative, notes IPWatchdog. See also: Bloomberg. Picture monitoring and legal-tech service Pixsy customers that it suffered what it calls an “IT challenge” and has advised them to change their passwords, notes TechNewsCrypt. The company says, however, that no data was compromised. According to reports, Pixsy does not explain the details of the “IT issue.” Pixsy is an online image monitoring service that keeps track of creatives and image owner media and determines how copyrighted images are being used online.
