Legal Brief: Photographer Sues Over Album Artwork in Precedent-Setting Case

A photographer is suing music streaming service Napster for using his image of a musician without the proper license in a case that could set a precedent requiring record labels to verify what rights were secured from photographers when their pictures were licensed for use on album covers. In 1979, explains PetaPixel, British photographer Adrian Boot shot a portrait of reggae artist Sugar Minott; in 2005, music label Soul Jazz Records licensed Boot’s image for use in the artwork for the release of the album “Sugar Minott At Studio One.” The label’s distributor PIAS then delivered the album, along with artwork including Boot’s photograph, to Napster.   Read the full Story >>

State of the Art: YouTube Says Training Sora with It's Video Would Violate Rules

OpenAI has been vague about what data was used to train its new Sora text-to-video generator But YouTube Chief Executive Officer Neal Mohan has made it clear that the use of YouTube videos to train Sora would be an infraction of the platform's terms of service. “[W]hen a creator uploads their hard work to our platform, they have certain expectations,” Mohan said in an interview with Bloomberg. Last month, OpenAI CTO Mira Murati said she wasn’t sure whether Sora was trained on sources like YouTube, adds The Verge.
